Liability Waiver & Assumption of Risk
1. Acceptance
By participating in an UrbanSnapHunt experience, I acknowledge that I have read, understood, and agree to this Liability Waiver & Assumption of Risk.
I understand that participation is entirely voluntary.
2. Nature of the Activity
UrbanSnapHunt is a self-guided, app-based urban scavenger hunt taking place in public areas throughout Amsterdam.
Participants complete challenges while navigating the city independently.
The activity may involve:
- Walking;
- Using public transportation;
- Cycling (optional);
- Visiting public spaces;
- Visiting partner bars or businesses;
- Interacting with members of the public.
UrbanSnapHunt does not provide supervision during the activity.
3. Voluntary Participation
I voluntarily choose to participate and accept responsibility for my own decisions and actions throughout the experience.
I understand that I may stop participating at any time.
4. Assumption of Risk
I understand that participation involves inherent risks, including but not limited to:
- Slips, trips, and falls;
- Uneven pavements;
- Busy roads and traffic;
- Cycling hazards;
- Weather conditions;
- Public transport delays;
- Encounters with members of the public;
- Fatigue or physical exertion;
- Theft or loss of personal belongings;
- Technical issues affecting mobile devices or internet connectivity.
I knowingly and voluntarily assume these risks.
5. Personal Responsibility
I agree that I am responsible for:
- My own safety;
- My own actions;
- Following all Dutch laws;
- Obeying traffic regulations;
- Respecting public and private property;
- Respecting local residents and businesses;
- Making sensible decisions throughout the activity.
6. Cycling
UrbanSnapHunt is designed primarily as a walking experience.
Participants may choose to use bicycles at their own discretion.
If I choose to cycle, I confirm that:
- I am confident cycling in Amsterdam traffic;
- My bicycle is safe and roadworthy;
- I will comply with all traffic laws;
- I accept full responsibility for all risks associated with cycling.
UrbanSnapHunt does not provide bicycles or cycling equipment.
7. Public Transportation
Participants may choose to use public transportation during the experience.
UrbanSnapHunt is not responsible for:
- Delays;
- Service interruptions;
- Missed connections;
- Additional transport costs.
8. Medical Fitness
I confirm that I am physically capable of participating.
If I have any medical condition that could affect my safety, I have obtained appropriate medical advice before participating.
I accept responsibility for monitoring my own physical condition throughout the activity.
9. Alcohol
Some checkpoints may include partner bars.
Purchasing alcohol is never required.
If I consume alcohol before or during the experience, I remain fully responsible for my behaviour, decisions, and safety.
UrbanSnapHunt may remove participants whose behaviour is unsafe, abusive, or excessively intoxicated.
We are not and never will be responsible for any irresponsible behavior and/or any fines that may be received by law enforcement or places of commerce.
Any and all extra costs along the hunt will 100% be covered by the participant.
10. Personal Property
I am solely responsible for my personal belongings, including but not limited to:
- Mobile phones;
- Cameras;
- Wallets;
- Bags;
- Clothing;
- Bicycles.
UrbanSnapHunt accepts no responsibility for loss, theft, or damage to personal property except where required by law.
11. Mobile Devices
Participation requires the use of a compatible smartphone.
I accept responsibility for ensuring:
- My device is sufficiently charged;
- My device has internet access where required;
- My device functions correctly.
UrbanSnapHunt is not responsible for interruptions caused by participant-owned devices or mobile networks.
12. Photography
I understand that photographs may be taken during the activity.
Where I upload photographs through the UrbanSnapHunt platform, I confirm that:
- I own the images or have permission to share them;
- The images do not infringe the rights of others.
UrbanSnapHunt will only use submitted photographs for promotional purposes where any required consent has been obtained.
13. Release of Liability
To the fullest extent permitted by Dutch law, I release UrbanSnapHunt BV, its directors, employees, contractors, volunteers, partners, and affiliates from liability for claims arising out of or connected with my participation, including claims relating to:
- Accidental injury;
- Loss of personal belongings;
- Property damage;
- Delays;
- Third-party actions;
- Technical failures beyond UrbanSnapHunt's reasonable control.
This release does not apply to liability arising from intentional misconduct, gross negligence, fraud, or any liability that cannot legally be excluded under applicable law.
14. Indemnification
I agree to indemnify and hold harmless UrbanSnapHunt BV against claims, damages, losses, or legal costs arising from my own unlawful, negligent, or reckless actions during participation.
15. Emergency Situations
In the event of an emergency, I understand that UrbanSnapHunt is not an emergency service.
If immediate assistance is required, I will contact the appropriate emergency services by calling 112 or seek assistance from local authorities.
16. Governing Law
This Liability Waiver & Assumption of Risk shall be governed by the laws of the Netherlands.
Any disputes shall be submitted to the competent courts of the Netherlands unless mandatory law provides otherwise.
17. Acceptance
By booking or participating in an UrbanSnapHunt experience, I confirm that:
- I have read this Liability Waiver & Assumption of Risk in full;
- I understand its contents;
- I voluntarily agree to its terms;
- I understand the risks associated with participation;
- I agree to comply with all UrbanSnapHunt rules and instructions.
